Although pre-nuptial agreements are not strictly enforceable in English law at present, they are taking on an increasingly important role and the Courts are more and more willing to give effect to the intention expressed in them. Other European countries give them full effect and enforce pre-nuptial agreements. It is very likely that UK law will follow suit shortly and they are worth considering.
