Police Station Advice & Assistance

Every individual is entitled to free and independent legal advice at the Police Station, under the government Legal Aid scheme.  We are experienced in dealing with all manner of criminal offences from a straightforward shoplifting matter right through to a murder trial.  We are available 24 hours a day, 7 days a week. Tim Stirmey is a Duty Solicitor on the local Eastbourne and Hailsham schemes, but our criminal solicitors travel to police stations all over Sussex and further afield.

If you are ever arrested, you have the right to have a named solicitor represent you, or alternatively, you can ask for the local duty solicitor.

In recent years, the police have introduced a new method of investigating a crime, where the accused is asked to attend the police station for a “voluntary interview”. This interview is conducted under the Police and Criminal Evidence Act 1984 and is therefore, just as serious as an interview following an arrest. You are entitled to have a solicitor to attend “voluntary inteviews” and we would always advise that you do not proceed without one, not least because the service is free of charge.

Magistrates & Crown Court Matters

Our criminal solicitors are experienced criminal advocates and will attend the Magistrates Court with you, advise you as to the issues in your case and represent you in court. The Legal Aid Scheme, means that such representation may be free of charge. The system is means and merits tested and we are able to advise  you as to whether legal aid may be granted in your case.

Should your case progress to the Crown Court, then Legal Aid will almost certainly be available, but this may involve you having to pay a financial contribution. This is also a means and merit based scheme. We regularly instruct experienced local barristers to represent our clients in Crown Court proceedings. In addition, Genei Haines is a qualified Solicitor Advocate and is able to conduct her own advocacy in the Crown Court. We will always discuss your options with you and establish your preferred advocate and will remain involved in your case, as part of your legal team.

Private Fees

If you do not qualify for Legal Aid, we are happy to represent you on a private basis. We can discuss your options with you and in some cases, would be able to offer a fixed fee service. Our private fees are very competitive.

If you have paid to privately fund your case and were acquitted after a trial, we would make an application on your behalf, for a payment from Central Funds, to endeavour to recoup at least some of your costs.

If you would like to ask any questions or to receive an estimate of costs, you can:-

  • Telephone our offices on 01323 720581 / 431292.
  • Email us by clicking Contact us.
  • Arrange to see somebody face to face either at our offices or we will come to see you. There is no extra charge for a home visit for elderly or disabled people. We can arrange appointments outside office hours.
